PRIVACY POLICY


1.    General introduction

Welcome customers and partners (hereinafter collectively referred to as “Customers”) to access the BitCake Platform. BitCake Platform includes all applications, websites, utilities, digital solutions, and services operated by BitCake Technology Company Limited, with tax code of 0318339203, address at Floor 10 TNR building, number 180-192 Nguyen Cong Tru, Nguyen Thai Binh Ward, District 1, Ho Chi Minh City (hereinafter referred to as “BitCake”).

BitCake is committed to respecting privacy and endeavors to fulfill its responsibilities in securing the personal data of all Customers using the BitCake Platform in accordance with Vietnamese law.

BitCake always appreciates the importance of securing all personal data and private information (hereinafter collectively referred to as “DLCN”) that Customers share and provide. Therefore, BitCake has conscientiously and responsibly created this Privacy Policy (“Policy”) for the purpose of establishing the agreement as well as informing all Customers about BitCake's regulations when managing, collect, use, process, store and disclose DLCN (collectively, “Collection”) in connection with Customers on the BitCake Platform. This is to ensure that all Customers are clearly and fully aware of the Policy before registering, accessing and using the BitCake Platform.

By registering, using and participating in activities on the BitCake Platform, the Customer has read, understood and agreed to comply with all terms and conditions of this Policy, along with any amendments (if any). from time to time published on the BitCake Platform, as well as applicable Vietnamese laws. At the same time, the Customer agrees to allow BitCake the right to collect, store, use, process and share DLCN as specified in this Policy.

2.    Scope of application

BitCake’s personal data processing activities (is one or more activities affecting personal data such as: Collecting, recording, analyzing, confirming, storing, editing, publishing, combining, accessing, retrieving, revoking, encrypting, decrypt, copy, share, transmit, provide, transfer, delete, destroy personal data or other related activities) when the Customer accesses, registers, uses the BitCake Platform or any other related service provided by BitCake.

Personal data information is understood as Information about the Customer and all other information related to the Customer, in the form of symbols, letters, numbers, images, sounds or similar forms on the electronic environment associated with a a particular person or helps to identify a particular person. Personal data includes basic personal data and sensitive personal data.

The scope of DLCN allowed by the Customer to be collected by BitCake during the process of accessing and using the BitCake Platform and/or services provided by BitCake, includes the following data:

(i)    Customer identification information, bank account information, balance information, asset information, transaction information, and individual location data identified through positioning and images of Identification documents (for individuals), images of establishment licenses, business registration certificates (for organizations); Phone number; Other payment account information; Photo of the Customer’s face, and other information (if any) that may arise because the Customer provides or allows collection, access, and storage when the Customer uses the service/ any features, any products on the BitCake Platform or as notified/ requested by BitCake in each specific case;

(ii)    Information about transactions and activities on the Customer's account includes, but not limited to: Payment transactions, spending payment history, activity history, account balance fluctuations on the BitCake Platform, bonus points/ account accumulated points (if any), promotional codes/vouchers (if any), promotions/customer incentives (if any); Change/reset Payment Password (PIN); Information arising related to other activities implemented by BitCake in cooperation with partners on the BitCake Platform.

(iii)    Information sent through the BitCake Platform from computers, phones, or other devices that Customers use and access the BitCake Platform such as: Data of websites, applications that Customers access, IP address, Customer location, device identification ID, device type, computer information, mobile devices, network devices, website display statistics, accessed applications and other data; When Customers access BitCake's products and services, or access third-party websites and applications that cooperate with online services that BitCake provides, BitCake and its business partners and suppliers may use cookies and tracking tools (collectively, Cookies) to identify you as a User and to customize your online experience, the Services you use, as well as content, advertise and introduce other online products; measure the effectiveness of promotions and perform analytics; and to minimize risk, prevent potential fraud and promote trust and security in BitCake's services; Some aspects and features of BitCake's Services and products are only available using Cookies, so if Customer chooses to disable or refuse Cookies, Customer's use of the Services may be limited or cannot be performed; When the Customer uses the device to access and use the service, depending on the structure, features, design of each type of device, the supplier allows the Customer to set up, configure, and select functions for each device. BitCake Services and products are allowed to access and use one, some, or all of certain information according to the Customer's preferences.

(iv)    Information created by the BitCake Platform or partners collaborating with BitCake, or BitCake's channels, regardless of whether they are affiliated or cooperated with a Third Party or not, such as: Information recorded by Customers on the system such as Identifiers, AppIDs, social network account identification information (Zalo ID,…), and any other information that the BitCake Platform, or of BitCake's partners, or third parties collaborating with BitCake, created to identify Customers when accessing and using products and services of BitCake or of Third Parties cooperating with BitCake.

(v)    Information for bank account linking and payment on the BitCake Platform, including but not limited to: bank account name and number, linked bank information, bank account registration phone number and related information.

(vi)    Information customers provide in communication media, social networks, e-commerce platforms, information provided to third parties needed to serve the connection, access or use of services, products on the BitCake Platform, including but not limited to: Customer preferences, location, account information, consumer trends, etc.

(vii)    Information related to Customers who are organizations and partners using services on the BitCake Platform, including but not limited to: goods, products, services posted, transactions (if any), information incentive/promotional programs for participating customers; Organization identification information (such as tax code, address, representative, legal entity name...),... ;

(viii)    Other information that BitCake needs to collect to fulfill its legal obligations according to legal regulations, BitCake Platform Terms and Conditions of Use, international practices, requests from competent authorities and according to other agreements between BitCake and Customers (if any).

3.    Customer Consent

When Customer registers, accesses or uses the BitCake Platform, or any service provided by BitCake, Customer confirms that Customer has read, understood and agreed to allow BitCake the right to collect, store, process, share and use DLCN according to the provisions of this Policy, accordingly, the Customer voluntarily shares data information with BitCake as prescribed in this Policy.

In case the Customer, or partners do not agree to allow BitCake to collect, use, store, share and/or process personal data or do not agree with any part of the Policy please do not register for, access, or use any part of the BitCake Platform or the services provided by BitCake, and must remove the installation of the BitCake Platform from Customer's devices, and stop using the services provided by BitCake. In case the Customer has accidentally provided the DLCN without agreeing to share it, the Customer must immediately send a written notice to BitCake to request the destruction or deletion of the DLCN that the Customer did not agree to share or use, and Customer must terminate use of the BitCake Platform and uninstall the BitCake Platform from the device used.

From time to time, BitCake may edit this Policy to update changes in the law, new features of the technology system or serve the deployment of services on the BitCake Platform. If the Customer continues to access, log in, and use the BitCake Platform or the services BitCake provides, it means that the Customer accepts the changes in the Policy from time to time.

Third Party Policy: In case the Customer accesses on behalf of a third party, the Customer is responsible for notifying and obtaining the consent of the authorized third party for compliance with this Policy. Customers ensure that BitCake will be exempt from all third party requests, complaints, and lawsuits related to the data and information provided as specified in this Policy. Customers are responsible for ensuring that all DLCN and information submitted to BitCake is complete, relevant, factual, and accurate. Furthermore, where Customer provides to BitCake or authorizes BitCake to use any DLCN relating to third parties (including Customer's spouse, children, parents and/or employees), the authorized third party consent to this Policy must be obtained by the Customer before providing DLCN to BitCake .

4.    Purpose of collecting and using DLCN

Customer agrees and authorizes BitCake to collect, store, process, use and share Customer’s DLCN for the following purposes (Collectively referred to as “Purposes”):

(i)    BitCake operates and provides services to Customers, including but not limited to:
 
  • Optimize features and services on the BitCake Platform;
  • Manage, maintain and upgrade service quality;
  • Check, verify and compare information to authenticate Customers;
  • Create a service link between the Customer's Account on the BitCake Platform and the Customer's information on a Third Party platform/system or service;
(ii)    Maintain and remember login account information: BitCake uses Customer information to maintain and manage Customer accounts on the BitCake Platform;

(iii)    Serving Customer care services and resolving complaints: Responding to Customer questions, requests and complaints during the process of using BitCake's services;

(iv)    Coordinate processing and sharing with Third Parties that cooperate with BitCake to optimize service quality, deploy new products, features, services or serve other functions and activities of BitCake from time to time, including but not limited to statistics, surveys, market research, trade promotion, business performance measurement, and information authentication assessment.

(v)    Promote and introduce products, services, promotions, research, surveys, news, updates, events, advertisements and related content about BitCake service and the services of partners who cooperate with BitCake;

(vi)    Personalization: BitCake may aggregate collected data so that BitCake better serves Customers by personalizing aspects, including but not limited to: (i) to improve and personalize the customer experience on the BitCake Platform, (ii) to improve utilities, services, adapt to personalized needs and come up with new appropriate service ideas.

(vii)    Security: Prevent account destruction, tampering, and fraud to ensure Customer safety when operating on the BitCake Platform;

(viii)    According to legal regulations: BitCake can collect, store and provide at the request of competent state authorities. In addition, to serve the need to resolve complaints or disputes related to the use of BitCake's services;

(ix)    Other purposes: For any other purpose of using DLCN not specified above, BitCake will specifically or publicly notify Customer via the BitCake Platform before using such information. In case the Customer receives notice or public information on the BitCake Platform but continues to use it without a written refusal to use the DLCN, it is understood that the Customer has agreed, without complaint, to the collection, store, process, use and share DLCN as above.

5.    DLCN collection

The Customer agrees and authorizes BitCake to collect the DLCN related to the Customer when the Customer takes any of the following actions:
 
  • Register for or access the BitCake Platform, or any services offered by BitCake and/or communicate any forms, requests in connection with any BitCake products and services or in connection with the Platform BitCake.
  • Use services operated by BitCake, including but not limited to accessing the BitCake Platform and using applications or widgets, plugins, Mini-Apps, or any other software, applications , any other technical solution that BitCake cooperates with third parties, or that BitCake operates.
  • Customers post and provide images, documents, information, and DLCN when participating in activities on the BitCake Platform or when requested by the BitCake Platform.
  • Contact BitCake to send questions, requests, or complaints for support.
  • Participate in membership programs, promotions, incentives, surveys or other events organized by BitCake itself, or in cooperation with Third Parties.
  • Referred to BitCake by business partners or third parties.
  • From other lawful sources: BitCake collects DLCN from other lawful sources, including but not limited to: Through Customer responses to information surveys on the BitCake Platform and/or email, recording activities Customer's call tone, Customer's confirmation on the BitCake Platform...etc
6.    Scope of use of DLCN
 
  • BitCake commits to using the Customer’s DLCN in accordance with the provisions of Vietnamese law. All use of DLCN is subject to this Policy and relevant legal regulations.
  • BitCake uses the Customer's DLCN to carry out the purposes detailed in this Policy or the terms of use publicly announced on the BitCake Platform.
  • In case of request from the competent authorities related to the investigation of the Customer's violations of law, the Customer agrees and BitCake has the right to provide the Customer's DLCN upon request of the competent authority.
7.    Information storage time
 
  • The Customer's personal data will be stored by BitCake in the BitCake Platform and BitCake reserves the right to comply with this Policy until the Customer requests in writing that BitCake remove all DLCN on the BitCake Platform and complete uninstall the BitCake Platform, discontinue use of the Customer Account issued by BitCake and the services operated by BitCake.
  • In all cases, BitCake is committed to securing the Customer's DLCN on the BitCake Platform. BitCake uses advanced technological security measures and implements strict security procedures to protect Customer data from unauthorized access, misuse, disclosure, alteration or destruction. inappropriate damage.
8.    Access information
 
  • BitCake commits not to disclose Customer's personal data to any third party that is unlawful, except for the cases clearly stated in this Policy or publicly announced on the BitCake Platform from time to time.
  • Providing the Customer’s DLCN to third parties is only executed in the following cases: (i) To BitCake’s partners conducting transactions with the Customer; (ii) When requested by competent State authorities; (iii) In cases where BitCake needs to protect its lawful rights before the law; (iv) Urgent and necessary situations to protect the safety rights of Customers operating on the BitCake Platform; (v) Transfer of business activities (if any); (vi) To carry out activities according to the functions of BitCake or according to the purposes and cases specified in this Policy.

10.    Methods and tools for customers to manage DLCN

In case the Customer wants to access, check, edit and update the DLCN, the Customer can log in to their personal account on the Bitcake Platform to do so, or contact directly to hotline: 1900 06 6868 or email at [email protected] for assistance in processing requests.

11.    Withdrawal of Consent, request for restriction and object to data processing

Unless otherwise provided by law, the Customer may withdraw consent to the collection, use and/or disclosure, or request deletion of the Customer's DLCN that BitCake maintains or controls, by sending a written notice to BitCake via email address at [email protected] and uninstall and discontinue use of any part of the BitCake Platform. At the request of the Customer, BitCake will stop collecting, processing, and using the Customer's DLCNs and delete the DLCNs that the Customer has shared unless otherwise (i) required by law or (ii) where BitCake has another lawful purpose to keep this information.

If the Customer requests to withdraw consent to the processing of the DLCN or request deletion of the DLCN, the Customer will not be able to continue using the BitCake Platform and BitCake will not be able to provide the products and services requested by the Customer. BitCake is not responsible for any loss or damage resulting from this termination. Your request to withdraw consent, delete or request deletion of your DLCN does not affect the lawfulness of the use, processing and sharing of data previously agreed.

12.    DLCN security

BitCake always tries its best efforts within the allowable scope to ensure the safety of Customer's DLCN, as follows:
 
-    Customer's DLCN on the BitCake Platform will be committed to absolute confidentiality in accordance with this Policy and compliance with the law. The collection and use of each Customer's information is only carried out when receiving that Customer's consent, except for other cases specified in the Policy and provisions of law.
-    In the event that the BitCake Platform is attacked resulting in the loss of the Customer's DLCN, BitCake will be responsible for reporting the incident to the authorities to promptly investigate, handle and notify the Customer whose DLCN is lost. cool to know.
-    When registering for membership, Customers must provide complete and accurate DLCN as requested from the BitCake Platform and are responsible for the legality of the information provided. BitCake is not responsible nor will it resolve any complaints related to customer information security if the data provided by the customer is inaccurate, incomplete and illegal.

13.    Customer's rights and obligations

Customers have the rights to: know, agree, access, withdraw consent, request data deletion, limit data processing, provide data, object to data processing, ... according to regulations under the law

Customers are obliged to: protect their personal data; request other relevant organizations and individuals to protect their personal data; Provide complete and accurate personal data when agreeing to allow BitCake to process personal data; Implement legal regulations on personal data protection and other obligations as prescribed by law.
